Why has my case been sent to the crown court?
Other cases can be sent to the crown court if the magistrates deem it’s sentencing powers insufficient. These are known as either way offences.
You do in certain circumstances have the right to elect trial by Judge and Jury if jurisdiction of your case is accepted by the Magistrates but if you would prefer your case to be heard by the Crown Court in any event.
Will I get legal aid?
If you have an annual household disposable income of £37,500 or more you will not be eligible for legal aid in a Crown Court trial. If your disposable income is above £3,398 but less than £37,500, you would have to make an income contribution towards your costs.
If you have above £30,000 in capital and equity and if convicted, you may have to contribute towards any remaining balance against your final defence costs.
We routinely take on privately paying work in the Crown Court.
